In 2023, a Connecticut jury awarded more than $1.4 million to two plaintiffs injured in a slip and fall accident outside a bank in Willimantic, CT. The injured plaintiffs were represented by McCoy & McCoy, a Connecticut personal injury law firm that regularly handles complex premises liability and slip and fall cases across the state of Connecticut.

The verdict was originally reported by the Connecticut Law Tribune, which covered the challenges involved in trying the case and the significant injuries suffered by the victims.

Although the jury returned a substantial verdict, the case did not end there. The defendants appealed the verdict, but the Connecticut Appellate Court affirmed the judgment, allowing the verdict to stand.

More recently, the court also granted post-judgement interest, significantly increasing the totally amount owed to the plaintiffs.

  • $222,000 for the Estate of our client
  • $63,000 for the other client

This additional interest significantly increased the total recovery beyond the original verdict amounts of $1,125,900 and $318,900.

The Slip and Fall Accident

The case arose from a dangerous condition outside a bank in Willimantic, Connecticut. According to the lawsuit, our clients fell due to a defective and unsafe condition on the property, which the defendants allegedly controlled and were responsible for maintaining.

Slip and fall cases like this often fall under Connecticut premises liability law, which requires property owners to keep their premises reasonably safe for visitors.

When dangerous conditions are allowed to exist, serious injures can occur.

Catastrophic Injuries from the Fall

The consequences of the fall were devastating.

One of our client’s suffered a cervical spinal cord injury that left him paralyzed, while the other one sustained injuries to their knee that affected their ability to work and maintain independence.

In many Connecticut personal injury cases, catastrophic injuries like spinal cord damage can require lifelong medical care, rehabilitation, and significant lifestyle adjustments.

A Challenging Trial

This case presented unique obstacles during trial.

Neither plaintiff was able to testify before the jury. One of the plaintiffs passed away before the trial began, which meant the jury had to rely on other evidence and testimony to understand the impact of the injuries and the events surrounding the fall.

Despite these significant evidentiary limitations, the jury ultimately found the defendants responsible for the dangerous condition that caused the fall and returned a verdict exceeding $1.4 million.

Verdict Affirmed by the Connecticut Appellate Court

After the trial, the defendants appealed the verdict.

However, in January of 2026, the Connecticut Appellate Court affirmed the judgment, meaning the jury’s decision remained intact. Courts also granted post-judgment interest, which added hundreds of thousands of dollars to the final recovery.

  • $222,000 for the Estate of our client
  • $63,000 for the other client

The total verdict ended up exceeding $1.4 million.

These additional amounts increased the overall recovery significantly.

Why Slip and Fall Cases Can Be Complex

Slip and fall cases often involve disputes over who controlled the property, whether a dangerous condition existed, and whether the property owner knew about the hazard.

In this case, the plaintiffs alleged that the defendants controlled and were responsible for maintaining the premises where the fall occurred.

Cases like this often require detailed investigation, expert testimony, and persistence through both trial and appeal.
